GTC

Our General Terms and Conditions (GTC) serve to protect you as a customer and us as a service provider. In our T&Cs you will find all the information about our services, the contractual terms, the termination options and the rights of withdrawal. Please read our GTC carefully so that you know what you can expect from us and what we expect from you. If you have any questions, please do not hesitate to contact us.

§ 1 Scope of application

1.1 These General Terms and Conditions (GTC) apply to all contracts concluded between RC-Creations KLG (hereinafter referred to as "we" or "RC-Creations") and our customers (hereinafter referred to as "customer").
1.2 Deviating terms and conditions of the customer are not recognized unless we expressly agree to their validity in writing.

§ 2 Subject matter of the contract

2.1 RC-Creations offers services in the field of social media marketing, including the creation and management of social media campaigns.
2.2 The exact services are agreed individually in the respective contract.

§ 3 Conclusion of contract

3.1 The contract is concluded when the customer accepts our offer.
3.2 The offers of RC-Creations are subject to change and non-binding.

§ 4 Prices and terms of payment

4.1 The prices quoted are net prices, plus the applicable statutory value added tax.
4.2 Payments are due within 14 days of invoicing without deduction, unless otherwise agreed.
4.3 In the event of late payment, we shall be entitled to charge interest on arrears at a rate of 10% above the prime rate.

§ 5 Provision of services

5.1 The service shall be provided after consultation with the customer and within the agreed deadlines.
5.2 If RC-Creations is prevented from providing the service on time due to force majeure or other unforeseeable events beyond our control, the delivery periods shall be extended accordingly.

§ 6 Obligations of the customer to cooperate

6.1 The client shall provide all information, content and materials necessary for the provision of services in a timely manner.
6.2 RC-Creations shall not be liable for delays caused by a lack of cooperation on the part of the client.

§ 7 Rights of use

7.1 The customer shall receive a simple right of use, unlimited in time and space, to the content created by us. Unless otherwise agreed.

7.2 Any disclosure to third parties or processing of the content requires our written consent.

§ 8 Liability

8.1 RC-Creations is only liable for intent and gross negligence.
8.2 We shall only be liable for slight negligence in the event of a breach of essential contractual obligations and limited to the foreseeable damage typical for the contract.

§ 9 Right of withdrawal

9.1 If the customer is a consumer, he is entitled to a statutory right of withdrawal.
9.2 The revocation must be made in text form within 14 days without giving reasons.

§ 10 Contract duration and termination

10.1 The contract term is agreed individually.
10.2 Both parties may terminate the contract for good cause. Termination must be in writing.

§ 11 Data protection

11.1 RC-Creations processes personal data of the customer exclusively for the purpose of fulfilling the contract and in compliance with the applicable data protection laws.
11.2 Further information on data protection can be found in our privacy policy.

§ 12 Final provisions

12.1 The law of the Republic of Austria shall apply.
12.2 Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
